These Terms of Service ("Terms") govern your access to and use of the Jukebox mobile application, website, and related services (collectively, the "Service"), operated by Jukebox HQ LLC, doing business as Jukebox ("Jukebox," "we," "our," or "us").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

By using the Service, you represent and warrant that:

Your content does not infringe intellectual property rights;

5. Community Standards

We encourage open discussion about music, artists, and culture.

The following content is prohibited:

Harassment or bullying;
Threats of violence;
Hate speech;
Illegal activity;
Spam or deceptive practices;
Pornographic or sexually explicit imagery;
Malware or harmful code;
Content that violates intellectual property rights;
Attempts to circumvent platform restrictions.

Discussion of explicit music, lyrics, artistic themes, and related cultural topics is permitted provided it complies with these Terms.

We reserve the right to remove content, restrict visibility, suspend accounts, or permanently terminate access at our sole discretion.

6. Third-Party Services and Music Data

The Service may utilize information, metadata, artwork, artist information, album information, track information, streaming links, and related content provided by third-party services.

These providers may include:

Spotify;
Apple Music;
MusicBrainz;
Ticketmaster;
Other current or future providers.

We do not guarantee the accuracy, completeness, or availability of third-party content.

Your use of third-party services may also be subject to their own terms and policies.

7. Intellectual Property

The Service, including its software, branding, design, functionality, logos, and original content, is owned by Jukebox HQ LLC and protected by applicable intellectual property laws.

Except as expressly permitted, you may not:

Reverse engineer;
Distribute;
Sell;
Lease;
License;
Create derivative works from the Service.

The name "Jukebox," associated branding, and related marks may not be used without prior written consent.

Your notice should include sufficient information for us to investigate and respond appropriately.

We reserve the right to remove allegedly infringing material and terminate repeat infringers.

9. Artificial Intelligence Features

The Service may incorporate artificial intelligence, machine learning, recommendation systems, automated moderation tools, content summarization tools, and similar technologies.

AI-generated outputs may be inaccurate, incomplete, or inappropriate.

You acknowledge that automated systems may make mistakes, and you agree to evaluate AI-generated information independently.

We reserve the right to introduce, modify, or discontinue AI features at any time.

10. Paid Features and Subscriptions

Certain features of the Service may become available through paid subscriptions, one-time purchases, or other premium offerings.

Pricing, billing terms, refund policies, and subscription details will be disclosed at the time of purchase.

We reserve the right to modify pricing, offerings, and subscription structures at any time as permitted by applicable law.

11. Account Suspension and Termination

We may suspend, restrict, disable, or terminate your account at any time if:

We believe your conduct creates risk for users or the Service;
We are required to do so by law;
We determine it is necessary to protect the integrity of the platform.

You may stop using the Service and delete your account at any time.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUKEBOX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUKEBOX HQ LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100 USD) OR THE AMOUNT PAID BY YOU TO JUKEBOX DURING THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

14. Indemnification

You agree to defend, indemnify, and hold harmless Jukebox HQ LLC and its affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, losses, expenses, and costs arising from:

Your use of the Service;
Your content;
Your violation of these Terms;
Your violation of applicable law.

15. Dispute Resolution and Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted in Maricopa County, Arizona, under applicable arbitration rules.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Governing Law

These Terms shall be governed by and construed under the laws of the State of Arizona, without regard to conflict of law principles.

17. Changes to These Terms

We may modify these Terms from time to time.

Updated versions will be posted through the Service and/or website.

Your continued use of the Service following changes constitutes acceptance of the revised Terms.
